Terms of engagement

These terms apply when you ask Webgardenhub to perform a measurement review or related engagement for a telecom customer app. By sending a brief, paying a deposit, or attending a sitting, you accept them.

Parties

Webgardenhub of Office 7, 27 Test Avenue, Johor Bahru 00000 provides the work. You are the company or team that commissions it. Individual employees who attend a sitting do so as representatives of that company.

The work

The engagement is professional services: written analysis, walkthroughs on agreed devices, and readouts. It is not a licence to software, not implementation inside your app, and not a guarantee of commercial results such as higher reload volume.

Acceptance and changes

A written fee and scope confirm the engagement. Changes to journeys, languages, or device sets after kickoff may be re-quoted. If you withhold test accounts or event catalogues for more than ten working days, we may pause the calendar or close the engagement and apply the refund rules.

Your materials

You warrant that you have the right to share event catalogues, store listing copy, and test accounts. You must not send live customer credentials or unnecessary personal data. Test accounts should be non-production.

Intellectual property

You retain rights in your app, catalogues, and brand. We retain rights in our methods and in template structures. Upon full payment, you receive a licence to use the written review and marked catalogues inside your organisation, including with your vendors, for the purpose of improving the measured app. You may not resell the review as a product or publish it as if we certified your app for a regulator.

Confidentiality

Both sides keep non-public materials confidential for three years after the engagement ends, except where disclosure is required by Malaysian law or by a regulator with authority over you.

Liability

We perform the work with reasonable care. We do not warrant that every event gap in a live app will be found. Our liability for a given engagement is limited to the fees you paid for that engagement, except where Malaysian law forbids a limit (including death or personal injury caused by negligence, or fraud). We are not liable for lost reload revenue, store ranking, or vendor delay.

Governing law

These terms are governed by the laws of Malaysia. The courts of Johor Bahru have exclusive jurisdiction, except that we may seek injunctive relief elsewhere to protect confidential materials.
